Odlukom Ustavnog suda prihvaćena je tužba odvjetnika jednog od navijača iz Splita, uhićenog nakon nereda na odmorištu Desinac, na autocesti između Zagreba i Karlovca, prije malo manje od mjesec dana. Utvrđeno je kako je u odnosu na njega povrijeđen članak 22. Ustava u kojem se govori o pravu na slobodu.

Ustavnu tužbu je podnio odvjetnik Toni Ivandić, koji zastupa uhićenog navijača.

- Ustavni sud utvrdio povredu u pogledu toga da nije utvrđena individualizirana osnovana sumnja, zatim glede opasnosti od ponavljanja kaznenog djela djela i glede primjene blažih mjera od istražnog zatvora.

Kako su svi navijači do sada pušteni iz istražnog zatvora, nisu ukinuta rješenja na temelju kojih su bili zatvoreni, već su utvrđene navedene povrede.

Moj klijent je otprije neosuđivan, a ustavnu tužbu sam podnio nedugo nakon pravomoćnosti rješenja suca istrage, kojim je određen istražni zatvor - kazao nam je odvjetnik.

Ustavni sud je, inače, jako ažuran u istražno zatvorskim spisima, odluče u pravilu unutar 30 dana, saznajemo od njega.

- Istraživanje još traje, a obzirom da je nejavno ne bih govorio o činjenicama. Poznato mi je da su još neke kolege podnijele ustavnu tužbu. Mogu vam najaviti da ću sada podnijeti ustavnu tužbu na odluku o mjerama opreza za mog klijenta.

I on je, kao i ostali koji su pušteni na slobodu, umjesto istražnog zatvora dobio zabranu približavanja na manje od tisuću metara bilo kojem sportskom događaju te obvezu javljanja policiji - objasnio nam je Toni Ivandić.

Za Ustavni sud je bilo sporno neselektivno lišavanje slobode za svih 38 navijača, koliko ih je ostalo pod sumnjom nakon što su četiri puštena na slobodu i obustavljen je kazneni postupak protiv njih. Uhićeni su, smatra Ustavni sud, isključivo na temelju procjene policije.

Trebao bi makar jedan dokaz da je određena osoba sudjelovala u masi. Nadalje, da se i utvrdila osnovana sumnja kako su počinili kazneno djelo napada na policiju, za određivanje istražnog zatvora trebalo se utvrditi tko je otprije kažnjavan, a tko nije.

U spornom predmetu je svima određen istražni zatvor zbog opasnosti od ponavljanja kaznenog djela, iako je tek dio otprije osuđivan. Uz to je za svih napisano isto obrazloženje, što također ukazuje da nije bilo individualizacije krivnje.

Upravo tih 14, koji već imaju kazneni dosje, državno odvjetništvo je već istaknulo kada se žalilo na odluku o zamjeni istražnog zatvora mjerom opreza te traži da ih se vrati u ćelije.

Odlukom Ustavnog suda prihvaćena je tužba odvjetnika jednog od navijača iz Splita, uhićenog nakon nereda na odmorištu Desinac, na autocesti između Zagreba i Karlovca, prije malo manje od mjesec dana. Utvrđeno je kako je u odnosu na njega povrijeđen članak 22. Ustava u kojem se govori o pravu na slobodu.

Ustavnu tužbu je podnio odvjetnik Toni Ivandić, koji zastupa uhićenog navijača.

- Ustavni sud utvrdio povredu u pogledu toga da nije utvrđena individualizirana osnovana sumnja, zatim glede opasnosti od ponavljanja kaznenog djela djela i glede primjene blažih mjera od istražnog zatvora.

Kako su svi navijači do sada pušteni iz istražnog zatvora, nisu ukinuta rješenja na temelju kojih su bili zatvoreni, već su utvrđene navedene povrede.

Moj klijent je otprije neosuđivan, a ustavnu tužbu sam podnio nedugo nakon pravomoćnosti rješenja suca istrage, kojim je određen istražni zatvor - kazao nam je odvjetnik.

Ustavni sud je, inače, jako ažuran u istražno zatvorskim spisima, odluče u pravilu unutar 30 dana, saznajemo od njega.

- Istraživanje još traje, a obzirom da je nejavno ne bih govorio o činjenicama. Poznato mi je da su još neke kolege podnijele ustavnu tužbu. Mogu vam najaviti da ću sada podnijeti ustavnu tužbu na odluku o mjerama opreza za mog klijenta.

I on je, kao i ostali koji su pušteni na slobodu, umjesto istražnog zatvora dobio zabranu približavanja na manje od tisuću metara bilo kojem sportskom događaju te obvezu javljanja policiji - objasnio nam je Toni Ivandić.

Za Ustavni sud je bilo sporno neselektivno lišavanje slobode za svih 38 navijača, koliko ih je ostalo pod sumnjom nakon što su četiri puštena na slobodu i obustavljen je kazneni postupak protiv njih. Uhićeni su, smatra Ustavni sud, isključivo na temelju procjene policije.

Trebao bi makar jedan dokaz da je određena osoba sudjelovala u masi. Nadalje, da se i utvrdila osnovana sumnja kako su počinili kazneno djelo napada na policiju, za određivanje istražnog zatvora trebalo se utvrditi tko je otprije kažnjavan, a tko nije.

U spornom predmetu je svima određen istražni zatvor zbog opasnosti od ponavljanja kaznenog djela, iako je tek dio otprije osuđivan. Uz to je za svih napisano isto obrazloženje, što također ukazuje da nije bilo individualizacije krivnje.

Upravo tih 14, koji već imaju kazneni dosje, državno odvjetništvo je već istaknulo kada se žalilo na odluku o zamjeni istražnog zatvora mjerom opreza te traži da ih se vrati u ćelije.
