Povodom teksta u članku „Čuvali Miljkovića kao vojnika Ryana, a sad su ga odlučili smijeniti“ objavljenog u Šibenskom listu 26. listopada 2023. godine., objavljujemo zahtjev Nadzornog odbora tvrtke Ceste Šibenik d.o.o. za objavom ispravka netočnih informacija.

„Povodom teksta u članku „Čuvali Miljkovića kao vojnika Ryana, a sad su ga odlučili smijeniti“ objavljenog u Šibenskom listu 26. listopada 2023. godine., uz dužno uvažavanje osobnih stavova autora, molimo u skladu s čl. 40. Zakona o medijima (NN 59/04, 84/11, 81/13, 114/22) ispravak netočnih informacija kako slijedi:

Vezano uz dio teksta u kojemu se navodi da su radnici angažirali najboljeg šibenskog odvjetnika kako bi dokazali da je odluka NO o suspenziji direktora suprotna ZTD-u te da bi zatražili postavljanje prinudnog upravitelja u tvrtku.

Kao prvo, nitko nikada nije sastavio rang listu kojom bi nekoga proglasio najboljim odvjetnikom u Šibeniku, ispred dosta kvalitetnih šibenskih odvjetnika. Kao drugo, privremena suspenzija jest mjera koju je Nadzorni odbor ovlašten zakonito poduzeti prema direktoru društva, što je „najbolji šibenski odvjetnik“ mogao saznati i od kakvoga laika. Nadalje institut prinudnog upravitelja koji se spominje u tekstu postoji u zgradama i stanovima u kojima suvlasnici nisu izabrali upravitelja, a ne u trgovačkim društvima, te takav navod ne može niti biti istinit. Konačno, tvrtka predstavlja naziv društva, pa se u naziv društva ne može postaviti privremeni upravitelj. Toliko o samoproglašenom „najboljem šibenskom odvjetniku“.

Vezano za dio teksta u kojem bi netko imao noćne more zbog postupaka najboljeg šibenskog odvjetnika.

Nitko nema noćne more zbog postupaka „najboljeg šibenskog odvjetnika“, nego zbog toga kako unaprijediti zatečeno stanje u CESTAMA ŠIBENIK d.o.o. Naime, u čl. 1 st. 4. Kolektivnog ugovora koji su potpisali i ovjerili sami sindikati radnika dana 4. listopada 2022. (Ur.br.:01/1945/23) doslovno se navodi: „Prema podacima FINA-e za 2022. godinu CESTE ŠIBENIK d.o.o. imaju daleko manju ostvarenu dobit u apsolutnom iznosu i po zaposlenom radniku od svih14 društava koja se bave održavanjem cesta u RH, i to u prosjeku pet puta, te je dobit za 2022. godinu povećana za dva i pol puta u odnosu na prethodnu godinu“. Službeni dokument u kojemu ovlašteni predstavnici radnika sami prepoznali potrebu sanacije društva nesporno ima svoju vjerodostojnost. Nadalje ovakvi novinski navodi su štetni po reputaciju društva u situaciji nakon što se isto doista stabiliziralo, kada je velika većina radnika povećala produktivnost, nakon upozorenja Hrvatskih cesta da bi mogli raskinuti ugovor s društvom (kao što su raskinuli ugovore sa srodnim društvima u Zagrebačkoj, Karlovačkoj, Sisačko-moslavačkoj i Slavonsko-brodskoj županiji) te kada se društvo susjedne županije već ponudilo preuzeti poslove društva. Da se naporima većine radnika stanje nije stabiliziralo „najbolji šibenski odvjetnik“ ne bi imao koga zastupati, pa uopće nije ni bitan.

Vezano uz dio teksta u kojem se izrijekom sugerira da netko po svaku cijenu štiti direktora.

Presumpcija nevinosti jedno je od temeljnih načela suvremenog sustava ljudskih prava. Osuđivati bilo koga po vlastitom nahođenju prije nego to učine nadležna tijela RH u suvremenoj civilizaciji ne egzistira više niti u Pyongyangu i tekovina je vremena koje je odavna trebalo biti iza nas. Ne ulazeći u postupanje nadležnih tijela, razlog za opoziv direktora isključivo može biti taj što u razumnom roku koliko je trajala njegova suspenzija nadležna tijela još uvijek nisu utvrdila njegovu krivnju ili nekrivnju. S posljedicama pravomoćne odluke kada god i kakva god ona bila tijela društva apsolutno nemaju niti mogu imati ništa – onaj tko pravomoćno bude osuđen odgovarat će za djelo koje je počinio, a onaj tko ne bude vjerojatno će ishoditi pozamašnu naknadu štete koju će netko morati snositi.

Vezano uz špekulacije i izboru novog direktora.

Za novog direktora društva biti će imenovana isključivo osoba koja se javi na natječaj i bude najkompetentnija za obnašanje funkcije, bez obzira na bilo čije ambicije. Pri tome je sasvim sigurno da stranačka ili partijska iskaznica neće imati novu ulogu.“, stoji u priopćenju koje potpisuje NO Ceste Šibenik d.o.o.

„Povodom teksta u članku „Čuvali Miljkovića kao vojnika Ryana, a sad su ga odlučili smijeniti“ objavljenog u Šibenskom listu 26. listopada 2023. godine., uz dužno uvažavanje osobnih stavova autora, molimo u skladu s čl. 40. Zakona o medijima (NN 59/04, 84/11, 81/13, 114/22) ispravak netočnih informacija kako slijedi:

Vezano uz dio teksta u kojemu se navodi da su radnici angažirali najboljeg šibenskog odvjetnika kako bi dokazali da je odluka NO o suspenziji direktora suprotna ZTD-u te da bi zatražili postavljanje prinudnog upravitelja u tvrtku.

Kao prvo, nitko nikada nije sastavio rang listu kojom bi nekoga proglasio najboljim odvjetnikom u Šibeniku, ispred dosta kvalitetnih šibenskih odvjetnika. Kao drugo, privremena suspenzija jest mjera koju je Nadzorni odbor ovlašten zakonito poduzeti prema direktoru društva, što je „najbolji šibenski odvjetnik“ mogao saznati i od kakvoga laika. Nadalje institut prinudnog upravitelja koji se spominje u tekstu postoji u zgradama i stanovima u kojima suvlasnici nisu izabrali upravitelja, a ne u trgovačkim društvima, te takav navod ne može niti biti istinit. Konačno, tvrtka predstavlja naziv društva, pa se u naziv društva ne može postaviti privremeni upravitelj. Toliko o samoproglašenom „najboljem šibenskom odvjetniku“.

Vezano za dio teksta u kojem bi netko imao noćne more zbog postupaka najboljeg šibenskog odvjetnika.

Nitko nema noćne more zbog postupaka „najboljeg šibenskog odvjetnika“, nego zbog toga kako unaprijediti zatečeno stanje u CESTAMA ŠIBENIK d.o.o. Naime, u čl. 1 st. 4. Kolektivnog ugovora koji su potpisali i ovjerili sami sindikati radnika dana 4. listopada 2022. (Ur.br.:01/1945/23) doslovno se navodi: „Prema podacima FINA-e za 2022. godinu CESTE ŠIBENIK d.o.o. imaju daleko manju ostvarenu dobit u apsolutnom iznosu i po zaposlenom radniku od svih14 društava koja se bave održavanjem cesta u RH, i to u prosjeku pet puta, te je dobit za 2022. godinu povećana za dva i pol puta u odnosu na prethodnu godinu“. Službeni dokument u kojemu ovlašteni predstavnici radnika sami prepoznali potrebu sanacije društva nesporno ima svoju vjerodostojnost. Nadalje ovakvi novinski navodi su štetni po reputaciju društva u situaciji nakon što se isto doista stabiliziralo, kada je velika većina radnika povećala produktivnost, nakon upozorenja Hrvatskih cesta da bi mogli raskinuti ugovor s društvom (kao što su raskinuli ugovore sa srodnim društvima u Zagrebačkoj, Karlovačkoj, Sisačko-moslavačkoj i Slavonsko-brodskoj županiji) te kada se društvo susjedne županije već ponudilo preuzeti poslove društva. Da se naporima većine radnika stanje nije stabiliziralo „najbolji šibenski odvjetnik“ ne bi imao koga zastupati, pa uopće nije ni bitan.

Vezano uz dio teksta u kojem se izrijekom sugerira da netko po svaku cijenu štiti direktora.

Presumpcija nevinosti jedno je od temeljnih načela suvremenog sustava ljudskih prava. Osuđivati bilo koga po vlastitom nahođenju prije nego to učine nadležna tijela RH u suvremenoj civilizaciji ne egzistira više niti u Pyongyangu i tekovina je vremena koje je odavna trebalo biti iza nas. Ne ulazeći u postupanje nadležnih tijela, razlog za opoziv direktora isključivo može biti taj što u razumnom roku koliko je trajala njegova suspenzija nadležna tijela još uvijek nisu utvrdila njegovu krivnju ili nekrivnju. S posljedicama pravomoćne odluke kada god i kakva god ona bila tijela društva apsolutno nemaju niti mogu imati ništa – onaj tko pravomoćno bude osuđen odgovarat će za djelo koje je počinio, a onaj tko ne bude vjerojatno će ishoditi pozamašnu naknadu štete koju će netko morati snositi.

Vezano uz špekulacije i izboru novog direktora.

Za novog direktora društva biti će imenovana isključivo osoba koja se javi na natječaj i bude najkompetentnija za obnašanje funkcije, bez obzira na bilo čije ambicije. Pri tome je sasvim sigurno da stranačka ili partijska iskaznica neće imati novu ulogu.“, stoji u priopćenju koje potpisuje NO Ceste Šibenik d.o.o.

Povodom teksta u članku „Čuvali Miljkovića kao vojnika Ryana, a sad su ga odlučili smijeniti“ objavljenog u Šibenskom listu 26. listopada 2023. godine., objavljujemo zahtjev Nadzornog odbora tvrtke Ceste Šibenik d.o.o. za objavom ispravka netočnih informacija.
